Dear Mrs Oliver

Your information request to Stockport MBC

Thank you for your correspondence dated 30/01/09 in which you complain about Stockport MBC’s failure to respond to your information request. I spoke with a representative of Stockport MBC today who confirmed that the request included in your email of 01/12/08 had been received and was receiving attention.

In cases such as this the Commissioner does not consider that serving a formal decision notice would serve any strong public interest. However, I have written to the public authority to provide them with a copy of your original request reminding it of its responsibilities and asking it to respond to you within 10 working days of receiving our letter. I enclose a copy for your information.

As you will see, even though the Commissioner does not intend to issue a formal notice in this case, your concerns have been taken seriously. Thank you for bringing this matter to the attention of the Information Commissioner.

If Stockport MBC responds and refuses to release the information you have asked for and you are dissatisfied, you may, after exhausting their internal complaints procedure, complain to us again.

This case has now been closed with the delayed response element showing as ‘withdrawn’ on our records. If you do not receive a response within 10 working days or are dissatisfied after having exhausted the internal review process mentioned above and would like us to look into the matter, please contact us quoting the reference number on this letter.

From the halcyon days when the Information Commissioner was prepared to force Stockport Council to be transparent. These days are long gone.

Dear Mrs Oliver

I refer to your email dated 27/11/08 which was sent to us in connection with case reference FS50214944. As the content of your email brought to our attention a further request for information to Stockport Metropolitan Borough Council (dated 05/10/08) it will be dealt with under a new reference FS50227814. I spoke with a council representative today and understand that the information you requested (Strategic Capital Group Report) was provided on 01/12/08.

In cases such as this the Commissioner does not consider that serving a formal decision notice would serve any strong public interest. Even though the Commissioner does not intend to issue a formal notice in this case, your concerns have been taken seriously.
