Mitigation measures must be in place before bypass for votes is opened, but the mitigation is impossible.

How will the bent Stockport LibDems sort out the insoluble traffic problems their road for votes will cause in High Lane/Disley, which they will have to do before the road opens. It can’t be sorted out. Does the corrupt LibDem road for votes remain shut then after £350m plus of public money has been spent on it?

Dear Ms XXXX

In response to your email of 15
April and with reference to the earlier correspondence sent to Mr David Rutley
dated 2nd April 2015, the contractor continues to work in accordance with the
various species specific ecological mitigation strategies which form part of the
approved planning permission from the three local authorities. The project team
is aware of the designation of Ladybrook Valley Interest Trail and Ancient
Woodland. To bring you up to date, as of 15th April the contractor’s ecologists
had identified and marked out 4 locations where nesting birds are evident and
the appropriate processes were followed and will continue to be in line with the
work systems referenced in the correspondence to Mr David
Rutley.

On the issue of mitigation
measures to reduce the impact of the scheme on Disley it is important to be
clear that a fully funded package of mitigation measures must be designed (in
agreement with the Local Planning Authority) and implemented prior to the
opening of the new road. This is a clear requirement of the Planning Approvals
granted for the scheme.

Cheshire East Council has
already commenced feasibility studies and initial consultation with Disley
Parish Council on proposals relating to mitigation measures in Disley,
specifically in relation to the requirements of this planning condition. The
mitigation measures for Disley will be developed through the feasibility and
consultation activities being progressed by Cheshire East Council and once
agreed and planning approval granted by Cheshire East Council LPA the measures
will be implemented prior to road opening which is programmed for October
2017.

Detailed assessments of impacts
on air quality have been undertaken and have concluded that the project will not
impact negatively on the ability of the UK to comply with the EU directives on
air quality. For the avoidance of doubt the estimated rise in the level of
traffic on the A6 at Disley is not 30%, but between 11 and
16%

I asked the Treasury for documents pertaining to Danny Alexander’s further decision to spend £350,000 on a pre-election boost for his political cohorts at Stockport to look into extending the road further. As it is the £350m A6 MARR roadscheme – or Cheadle Constituency Link Road as the LibDems refer to it – won’t solve the traffic problems in the area – not at High Lane, not on the A6 at Hazel Grove, not at Bredbury, not at Dan Bank.

HM Treasury have asked for an extension before they respond with documents relating to the Chief Secretary to the Treasury spending further huge amounts of my money to shore up votes for his political cohorts.

LibDems – could they, should they run a whelk stand?

“I am concerned that no coverage has been given to the negative effects of the
new airport road. Local residents have advised me that tree felling is going on
around Styal and the airport this morning for the A6-MARR. The pond in by the
Hale Barns Junction of M56 has been filled in where a large number of Great Crested Newts were moved to when they filled in the ponds for Runway 2 in 1997.
This pond was believed to contain one of the highest concentrations of this
supposedly ‘protected’ species in Cheshire.

How (if at all) has the
removal of this biodiverse pond ‘been mitigated’ and where have these newts been
moved to? This pond has been filled in to make way for airport-related
expansion. A6-MARR is part and parcel of the same scheme, just like the A556
destruction that is now well underway.

There has also been no
explanation of how mitigation of increased traffic pollution on the A6 in High
Lane and Disley is actually going to work, or whether it will. Residents are
already suffering from the effects of pollution with asthma an other respiratory
diseases increasing considerably in the area. Increased airport traffic will
also cause increased pollution to add to their woes.

How many more sacrifices do people have to make in
the name of “growth”? Why is only the monetary cost measured rather than the
true cost which includes cleaning up after destruction of the environment and
increased health care for those affected and the unseen costs to the other
species which lose their habitat? “

It would appear (and interested persons should seek legal advice on this) that the bypass authorities (Stockport, Greater Manchester and Cheshire East) “may be liable under Part 1 Land Compensation Act 1973 to pay compensation for depreciation in the value of an interest in land with is attributable to the use of public works… and no land has been taken from the claimant.”

“Compensation is limited to depreciation in the market value of the qualifying interest caused by the use of the land or works but only in so far as that the depreciation is attributable to ‘physical factors’, which are defined in s 1LCA 1973 as noise, vibration, smell, fumes, smoke, artificial lighting, and the discharge on to the land in respect of which the claim is made of any solid or liquid substance.”

“A claim may be made by the owner of a qualifying interest, or by a mortgagee of such interest. The claim must be in the form of a notice served on the responsible authority and must contain particulars prescribed by s3 LGA 1973. Time limit for claim.”

“CEC discharge of planning conditions for the A6MARR/SEMMMS road

From the results released under FOI it appears that the pollution in Disley is considerably worse than previously assumed with hourly average exceedences in 2014 being exceeded 34 times more frequently than the legal limit in addition to annual average being the highest ever recorded in Disley.

CEC’s Air Quality team did warn the Council in 2013 that hourly exceedences might be
the consequence of the A6MARR although it has been assumed that hourly averages
have always been within the legal limits.

Poor air quality has been tolerated on the basis that the UK were at liberty to
decide how long corrective action plans took, contrary to the Directive which
required compliance by 2010 or for Nitrogen Dioxide, concessions to 2015
provided corrective action plans were submitted and agreed with the European
Commission. CEC never submitted action plans to the EC and currently, Disley is
not even included in the annual reporting to the EC. In effect Defra do not consider Disley at risk!

This dubious policy was first challenged in the courts in 2011 That case reached the European Court of Justice in 2013 and returns to the UK Supreme Court this April and a judgement expected in July. At every stage from the Supreme court upwards the UK Government have been reprimanded.

After July then, CEC will have to submit emergency action plans, and the UK courts
have to enforce air quality law, the deterrent being yearly fines until
compliance is achieved. For London these fines have been estimated at £300M.

I would therefore urge the Council to ensure Disley does not suffer a further
worsening of air quality due to the A6MARR increasing A6 traffic from the
current 15k vehicles per day to 27k when the road opens which, by the way, the
applicants argued would make an insignificant impact on air pollution. Or at least consider an emergency action plan to mitigate the severity of fines from the UK courts.

I also enclose my letter to the Secretary of State for Transport which contains a
little more detail.
